Digital Millennium Copyright Act Notice and Takedown Policy

My Life Shift Journey ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), the text of which may be found on the U.S. Copyright Office website at www.copyright.gov, we will respond expeditiously to claims of copyright infringement committed using our website if such claims are reported to our designated DMCA Agent identified below.

1. DMCA Notice of Alleged Copyright Infringement

If you are a copyright owner, or are authorized to act on behalf of one, and you believe that copyrighted work has been copied or used on our website in a way that constitutes copyright infringement, please submit your claim via email or mail to our DMCA Agent with the following information:

  1. Physical or Electronic Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works on the website are covered by a single notification, a representative list of such works.
  3. Identification of the Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. Providing URLs in the body of your notice is the best way to help us locate content quickly.
  4. Contact Information: Information reasonably sufficient to permit us to contact you, such as your name, address, telephone number, and email address.
  5. Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy Statement: A statement, made under penalty of perjury, that the information in the notification is accurate, and that you are the copyright owner or are authorized to act on behalf of the owner.

Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees. If you are unsure whether the material you are reporting is in fact infringing, you should contact an attorney before filing a notification.

3. DMCA Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with our Designated Agent. A counter-notification must include the following:

  1. Physical or Electronic Signature: Your physical or electronic signature.
  2. Identification of Material: Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
  3. Good Faith Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  4. Consent to Jurisdiction: Your name, address, telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the District of Wyoming if your address is outside the United States), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, we will forward it to the party who filed the original DMCA notice. If the original complainant does not file a lawsuit against you within ten (10) business days of receiving the counter-notification, we may restore the removed material.

4. Repeat Infringers

In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our website or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
